Privacy Policy

Effective Date: March 14, 2026

1. Introduction

DSP Maxxer, LLC ("DSP Maxxer," "Company," "we," "us," or "our") operates the DSP Maxxer platform at app.dspmaxxer.com (the "Platform" or "Service"). This Privacy Policy describes how we collect, use, disclose, and protect information in connection with the Service.

DSP Maxxer is a business-to-business ("B2B") software platform serving Amazon Delivery Service Partners ("DSPs"). This Privacy Policy applies to our customers ("you" or "Customer") and to individuals whose personal information may be present in the data we process on our customers' behalf.

By using the Service, you acknowledge that you have read and understood this Privacy Policy. This Privacy Policy is incorporated into and subject to our Terms and Conditions.

2. Information We Collect

2.1 Information You Provide

We collect information you provide when you create an account, subscribe to the Service, or communicate with us. This may include business contact information (name, email, phone number, company name), account credentials necessary for the Service to operate on your behalf, and the content of communications you send to us.

Payment information (such as credit card numbers) is collected and processed directly by our payment processor, Stripe. We do not receive or store full payment card numbers.

2.2 Information Collected Through the Service

When you authorize us to operate on your behalf, we may collect and process delivery operations data, performance metrics, and related business information from your Amazon DSP account. This data may include information about deliveries, delivery associates, customer feedback, and operational performance.

Certain data—such as delivery images—may be accessed and processed transiently in the course of providing the Service but is not stored or retained beyond the immediate processing session.

2.3 Information from Third Parties

We may use third-party services to supplement or enrich the data we process. For example, we may use mapping services to resolve location data into addresses. Third-party providers' use of data is governed by their own privacy policies.

2.4 Information We Generate

In providing the Service, we generate analytical outputs, recommendations, and reports based on the data we process. These outputs become part of the data associated with your account.

3. How We Use Information

We use the information we collect to:

  • (a) Provide, maintain, and improve the Service;
  • (b) Generate analytical outputs, recommendations, and reports on your behalf;
  • (c) Develop and improve our technology, including training and refining AI models using aggregated and anonymized data;
  • (d) Communicate with you regarding the Service, respond to inquiries, and provide support;
  • (e) Process payments and manage subscriptions;
  • (f) Detect, prevent, and respond to security incidents, fraud, and abuse; and
  • (g) Comply with applicable laws, regulations, legal processes, or governmental requests.

4. How We Share Information

We do not sell your personal information or Customer Data. We share information only in the following circumstances:

4.1 Service Providers

We use third-party service providers to help operate the Service, including providers of cloud infrastructure, artificial intelligence and machine learning capabilities, mapping and geocoding services, and payment processing. These providers receive only the data necessary to perform their functions and are contractually obligated to use it solely for the purpose of providing services to us and to maintain appropriate security measures.

4.2 AI Processing

Our Service uses third-party AI models to generate analytical outputs. Data submitted to our AI provider for processing is not used by the provider to train their models and is not retained beyond the short processing window necessary to generate a response, in accordance with our agreement with that provider.

4.3 Actions on Your Behalf

When you authorize us to take actions on your behalf through third-party platforms, we transmit information necessary to perform those actions. Such actions are taken in your name and using access you have provided.

4.4 Legal Requirements

We may disclose information if we believe in good faith that disclosure is necessary to:

  • (a) Comply with applicable law, regulation, legal process, or governmental request;
  • (b) Enforce our Terms and Conditions;
  • (c) Detect, prevent, or address fraud, security, or technical issues; or
  • (d) Protect the rights, property, or safety of DSP Maxxer, our customers, or the public.

4.5 Business Transfers

In the event of a merger, acquisition, reorganization, bankruptcy, or other sale of all or a portion of our assets, information we hold may be transferred as part of that transaction. We will provide notice before information becomes subject to a different privacy policy.

5. Data Roles

The data we process on your behalf may contain personal information of third parties, such as delivery recipients. DSP Maxxer processes this information solely as a service provider acting on your behalf. You are responsible for ensuring that your use of the Service complies with your obligations to such third parties and applicable law.

We do not independently contact delivery recipients or use consumer information for any purpose other than providing the Service to you.

6. Data Retention

We retain your data for the duration of your active subscription. Following termination, we retain data for up to ninety (90) days to allow for account wind-down and data export. After this period, identifiable data is deleted from our active systems. You may request earlier deletion by contacting us.

We may retain aggregated and anonymized data—which cannot be used to identify you, your personnel, or specific individuals—indefinitely for the purpose of improving the Service, training AI models, and generating industry insights.

Account credentials used to access third-party platforms on your behalf are deleted promptly upon termination or upon your request, whichever occurs first.

7. Data Security

We implement technical, administrative, and organizational security measures designed to protect the information we process. These include encryption of data at rest and in transit, strict access controls, data isolation between customers, and transient processing of sensitive data categories that are not written to persistent storage.

While we implement industry-standard practices, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

8. Your Rights and Choices

You may request access to, export of, correction of, or deletion of your data by contacting us at hello@dspmaxxer.com. We will respond to requests within thirty (30) days.

You may revoke our access to third-party platforms at any time by changing or deactivating the credentials you have provided or by requesting that we delete them. Revoking access will prevent us from providing the Service.

Deletion of your data may require termination of your subscription, as the data is necessary for us to provide the Service.

9. State Privacy Rights

Certain U.S. state privacy laws provide individuals with specific rights regarding their personal information. While DSP Maxxer is a B2B platform whose direct customers are businesses, the data we process may contain personal information of consumers.

We do not sell personal information as defined under the California Consumer Privacy Act (CCPA/CPRA) or any other state privacy law. We do not share personal information for cross-context behavioral advertising.

If you are an individual (such as a delivery recipient) who believes we hold personal information about you, you may contact us at hello@dspmaxxer.com. We will direct such requests to the relevant customer where appropriate.

10. Children's Privacy

The Service is designed for use by business operators. We do not knowingly collect personal information from children under the age of 13. If we become aware that we have collected such information, we will delete it promptly.

11. Data Transfers

We process and store data in the United States. By using the Service, you consent to the processing and storage of information in the United States.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the "Effective Date" above and, where appropriate, notify you by email. We encourage you to review this Privacy Policy periodically.
